       the entry into building illegally with intent to commit a crime, especially theft; the crime of so doing.

背景知识
 

       在英美法中，burglary曾被定义为：the breaking and entering of the dwelling house of another person at night with the intention to commit a felony on larceny inside，即行为人以犯重罪或盗窃为目的、在夜间破门窗入他人住宅的行为，曾译为“夜盗罪”。

       当今刑法对burglary的定义已有了很大的修订，时间并不局限于夜间，地点也不局限于住宅，还可以包括其他建筑物。

       美国《统一刑事案例汇编》(Uniform Criminal Reports)(1998)甚至把 burglary简单地定义为“为犯重罪或偷窃而非法进入某一建筑内”。为了伤害、强奸甚至杀害某人而进入他人住宅或其他建筑物，同样也构成 burglary。

       此罪成立不仅需要非法进入他人住宅或其他建筑物，而且需要行为人有与此行为相关的实施相应重罪的意图。
